Judge Rejects 'Obscene' Name Change

SANTA FE, N.M. (June 28) - A New Mexico appeals court on Friday ruled against a Los Alamos man who wanted to change his name to a phrase containing a popular four-letter obscenity.
The man appealed after a state district judge in Bernalillo County refused his request to change his name to "Fuck Censorship!"
Judge Nan Nash ruled that the proposed name change was "obscene, offensive and would not comport with common decency."
The man - whose current legal name is Variable - argued on appeal that it was improper government censorship to deny him the name change.
"We do not believe that the district court's action infringes on petitioner's right to free speech," a three-judge panel of the Court of Appeals said in its ruling.
The man has the right to call himself whatever he wants, unless there's fraud or misrepresentation involved, the judges said.
But once he seeks court approval for a name change, the court has the authority to turn him down on several grounds, including if the name is offensive to common decency and good taste, the judges ruled.
That law was clarified in a 2004 case in the same court that apparently involved the same petitioner. In that case, an Albuquerque man whose name was Snaphappy Fishsuit Mokiligon got the go-ahead from the appeals court to change his name to Variable.
INTERESTING FACTS FOUND UNUSUAL NAMES
Last year, New Zealand authorities blocked a couple's bid to officially name their new son "4Real," saying numerals are not allowed.
Also in 2007, Sweden refused to allow a couple to name their daughter "Metallica," after the rock group.
Germany has laws against naming children Adolf Hitler and Osama bin Laden.(No big surprise)
French parents must choose baby names from an approved list. The laws are designed to prevent teasing.(won't be naming your daughter Shaquita in France)
In America, "You can't use a four letter word that I wouldn't use in this interview," a sociologist said, "and other than that you're free to do what you want."(Fluffy is 6 letters)
One Michigan boy and one Texas boy have been named ESPN after the sports network based in Bristol, Conn.(HUH? Correct me if I am wrong but I think that 4 letters and it's definitely OBSCENE!)
Singer Sonny Sandoval of P.O.D. named his daughter Nevaeh, or heaven spelled backward, in 2001. It has grown faster in the U.S. than any name in the last century.(I think I am gonna change my name to Yffulf...wonder if will catch on like Nevaeh hehe)

| It sounds like he's trying to get the name just to cause a big stir. Why waste everyone's time? It makes the guy sound crude and ignorant. Have a regular name and then actually take actions to fight censorship. |

he's trying to make a statement.
that statement is "look at me."
a lot of people are probably yelling "olol the government can't tell you what to call yourself!" turns out, when your name is an affront to common "decency" they can tell you no. just like when you feel like you want to run around the streets with no clothes, or do anything else considered "obscene." let fuck censorship be his nickname if he actually wants to be called that. if it was improper for the government to deny a name change, why even have that process at all?
let's say, even, ok, his name gets legally changed. so. . .now what? you gonna apply for jobs with that name? good luck with that. or how about getting any sort of legal documentation with that name? you'll have to prove that is actually your name, because who in the blue fuck is going to believe you're actually called that?
your name is already variable. no one takes you seriously. |

| Maybe we are underestimating the circumstances of the name change. Maybe a friend of his bet him he couldn't come up with a more ridiculous name than Variable. |

also, fluffy isn't nearly as ridiculous as variable. we were all thinking it, i'm sure. |
